PROGRAMME ON CO-OPERATION BETWEEN FAS RUSSIA AND COUNCIL FOR ECONOMIC DEFENCE, SECRETARIAT OF ECONOMIC LAW OF MINISTRY OF JUSTICE OF FEDERAL REPUBLIC OF BRAZIL AND SECRETARIAT OF ECONOMIC MONITORING OF MINISTRY OF FINANCE FOR 2006-2007

Federal Antimonopoly Service of the Russian Federation (FAS Russia) and Council for Economic Defence(CADE) and Secretariat of Economic Law (SDE) of Ministry of Justice of Federal Republic of Brazil conjointly with Secretariat of Economic Monitoring of Ministry of Finance of Federal Republic of Brazil (SEAE) hereinafter referred to as Parties,

expressing a will to develop a cooperation in the sphere of competition policy,

setting themselves the object to implement the Agreement between the Government of the Russian Federation and the Government of
the Federal Republic of Brazil on cooperation in the sphere of competition policy signed on 12 December 2001,

approved current Programme on co-operation for 2006-2007.

1. In compliance with the Article 4 of the Agreement on co-operation the Parties shall provide:

a) in the field of interchange of legislative acts, informational, methodological material between the Parties:
provide the other Party with the texts of the basic laws and legislation which make the ground of the Party's activity;
provide the other Party with methodological recommendations on the principle issues of the Party's activity;
provide the other Party with statistic and information data on the Party's activity.

Transfer of the materials shall be provided subject to the confidentiality rules of their laws and in English

b) in the field of providing methodical assistance, interchange of research results and holding consultations:

rendering of methodical assistance at the request of the other Party;
exchange of experience in the field of conducting investigations relevant to violations of competition legislation;
rendering consulting assistance at the request of the Parties;
assistance in providing information on the Party's economic entities acting on the territory of the other Party, if this activity may curtail affect upon the competition on the commodity markets of the other Party.

Exchanging information, the Parties should not infringe the confidentiality rules of the laws. The information provided by the Party should be open and accessible for other national economic entities, depending on the confidential nature of the information rendered.
Information requested will be submitted in time agreed by the both Parties, but no latter than forty five (45) days from the date the request has been sent.

The Parties take the responsibility of the information delivered by them.

c) in the field of attracting specialists of the other Party for taking part in the training process and probation aimed at experience exchange:

an opportunity to receive specialists of the other Party with the aim to exchange experience at the request of the other Party.
An annual exchange of the visits (two specialists for a duration of maximum five days) is assumed.

Communication between the Parties will be exercised in English.

d) in the field of holding bilateral symposia, conferences and seminars:

invitation of representatives of the other Party to participate in symposiums, conferences and seminars on competition policy organised by the Parties in 2006-2007.

2. The Parties shall organise annual meeting of the authority to discuss the process of realisation of this Programme, the perspective of bilateral cooperation and the issues of the mutual interest. The Parties shall hold the meetings of the Heads of the authorities once a year.

The date and the place of these meetings will be discussed in each concrete case.

3. The Parties shall provide public awareness on the progress and results of the realisation of the Programme.

4. Co-ordinators of the Programme shall be:

on the part of the FAS Russia - Deputy Head of the Administrative Department which supervises issues of international cooperation,
on the part of the CADE - Councillor on International Affairs of the Office of the Chairman,
on the part of the SDE - Director of the Department for Economic Defence and Economic Security,
on the part of the SEAE - Deputy Head of the SEAE which supervises the issues of the economic security and competition.

5. All expenses, including but not limited to travel expenses, transportation, food, accommodation, related to the visit of the specialists shall be covered by the Sending Party.

6. In case of need the Parties will have additional consultations on the issues concerning implementation of the Programme on co-operation in 2006-2007 and the Agreement Memorandum in general.

7. This Programme on cooperation is valid till 31 December 2007. Activities that have been started but are not finished by this time are considered when making Programme for the next time.

8. The Parties agree the provisions of the this Programme on cooperation till 31 December 2007.
