Regarding the implementation of the Agreement between the Government of the Russian Federation and the Government of the People's Republic of China on Cooperation in the Fields of Countering Unfair Competition and Antimonopoly Policy in the year of 2006-2007,
Federal Antimonopoly Service of the Russian Federation (FAS Russia) and State Administration for Industry and Commerce of the People's Republic of China (SAIC), hereinafter referred to as Parties, have agreed as follows:
1. During the period of validity of present Memorandum of Understanding, a regular high-level annual working meeting shall be held in Russia and China respectively. Besides consulting and discussing on issues of common interest, the Parties shall review and evaluate cooperation within current two years as well as sign the Memorandum of Understanding for the next two years in the second meeting.
2. A high-level bilateral meeting on competition policy and advertising regulation will be held in September of the year 2006 in Moscow and St. Petersburg, Russia. Expenses for the visit (including international air tickets and transportation cost between Moscow and St. Petersburg, diet and accommodation) will be covered by the sending Party; other expenses of the visit (for holding the meeting) will be covered by the receiving Party.
3. A high-level bilateral meeting on competition policy and advertising regulation will be held in September of the year 2007 in Beijing and Dalian, China. During the meeting, the Parties shall review and evaluate the cooperation in 2006-2007 and sign the Memorandum of Understanding for 2008-2009. Expenses for the visit (including international air tickets and transport cost between Beijing and Dalian, diet and accommodation) will be covered by the sending party; other expenses of the visit (for holding the meetings) will be covered by the receiving Party.
4. The Parties shall carry out exchanges of standard legal acts and other information:
- in the field of countering unfair competition, antimonopoly and advertising supervision;
- on occurred cases of unfair competition and advertising that affected the interests of economic entities of the other Party;
- on economic entities which activity contradicts to legislation of the other Party on competition protection and advertisement;
- on state policy concerning public enterprises and natural monopolies utilizing foreign capital, within the limits of antimonopoly agencies' competence of the Parties;
- on frontier regional offices of the Parties.
5. Informational exchange between the Parties shall be mainly carried out during the annual working meeting. If needed, the information exchange may also be proceeded by the way of mail or e-mail.
6. The Parties shall promote development of contact and cooperation in
- providing information on economic entities which operate at the territory of the other Party, without infringing confidential rules determined by the laws of the Parties; and
- investigating the facts of unfair competitive practices of economic entities of both Parties (on demand of the Parties).
7. The Parties shall interchange officials to share the legislation and enforcement experience in the fields of countering unfair competition, anti-monopoly and advertising regulation.
8. The Parties shall guide and coordinate the regional offices in frontier regions to consider and sign cooperation and exchange agreement on law enforcement, with a view to maintaining sound frontier trade order.
Memorandum of Understanding shall enter into force as of the date of signature and be valid till December 31, 2007.
Memorandum of Understanding is done on November 3, 2005 in Beijing, China, in Russian, Chinese and English, all three texts being equally authentic.
If any discrepancies arise from the interpretation of this Memorandum, English version shall prevail.
