In view of executing the Agreement on Co-operation in the area of Antimonopoly Policy, which has been signed on 15th March 1994, between the Government of the Russian Federation and the Government of the Republic of Poland ('Co-operation Agreement'), the Federal Antimonopoly Service of the Russian Federation (hereinafter - FAS Russia) and the Office of Competition and Consumer Protection of the Republic of Poland (hereinafter - UOKiK) have devised the following Programme of co-operation, for the years 2006-2007.
§1
According the Co-operation Agreement, the Parties commit themselves:
1) To exchange documents in the competence of the Parties, which will be provided in English or in the Parties' languages and sent by mail or exchanged during the Parties' meetings. The available documents include:
a) Texts of legal acts;
b) Educational and informational materials;
c) Data concerning monitoring systems, analyses and control of product markets (including the issues related to the functioning of databases, and organization of data collection and processing).
2) To organize a meeting in the year 2007 in order to sign a next Co-operation Programme.
3) To organize study visits or/and consultation meetings for experts of the other Party. By these means:
a) Each of the Parties organizes at least once a year a study visit or/and consultation meeting for the experts of the other Party.
b) In the year 2006 the hosting Party shall cover all expenses related to the study visits of experts from the other Party (including accommodation, full-daily board and travelling expenses within the territory of the hosting country). The visiting Party covers the travel expenses linked to the journey to and from the hosting country.
c) In the year 2007 the visiting Party shall cover all the expenses regarding the visit.
d) The hosting Party will provide the visiting Party with the access to computer network of the hosting Party, including the software, intranet, as well as CD-ROMs and e-mail, will enable copying materials (while assuring confidentiality and in a reasonable manner) as well using its library resources.
e) The hosting Party commits itself to organizing meetings in local organizational units, and other bodies of public administration as well as organizations and associations, provided it is required by the theme of the study visit or/and consultation meeting.
4) To invite representatives of the other Party to participate in symposia, conferences and seminars organized by the Parties of the Programme. Financing of the participation of the Parties' representatives will be agreed on every occasion.
§2
FAS Russia will co-operate with UOKiK in the areas related to its membership in the Commonwealth of Independent States (CIS), including providing assistance in establishment of working relations with antimonopoly and consumer protection authorities from the CIS.
§3
UOKiK shall co-operate with FAS Russia in the areas related to its membership in the European structures, including exchanging experience related to the harmonization of the Polish and the European legislation and the cooperation within the European Competition Network.
§4
If the need arises, the Parties may hold additional consultations on the realization of the Co-operation Programme and the Co-operation Agreement.
§5
The hereby Co-operation Programme becomes binding upon its signing until 31st December 2007. Uncompleted activities and projects shall be taken into consideration in the preparation of co-operation programmes for the following years.
§6
The Parties shall have signed the next Programme on co-operation for the years 2008-2009 by 31st December 2007.
§7
The hereby Programme, is signed in Warsaw, on 19 January 2006, in two identical copies - each one in Russian, Polish and English. In case of divergences in the interpretation, the English text will be considered as decisive.
