Press-release of 21.07.2008 «Ingushvodkhoz»

On 10th July 2008, the Federal Antimonopoly Service (FAS Russia) recognized that the «Ingushvodkhoz» Public Enterprise for Operational Management of Public Property of the Republic of Ingushetia violated the Federal Law «On State and Municipal Procurement of Goods, Works and Services «.

The case was initiated upon a complaint of the «Entarkho» charity fund. The Petitioner stated that «Ingushvodkhoz» had violated the law in an open bidding for the following water works: «Sedimentary control, improvement and dredging ðóñëà of the Yandare river bed», «Sedimentary control, improvement and dredging of the Kench river bed» and «Capital repairs of the Troitsky-Sadovy Channel, water intake and outlet facilities».

In its complaint, the Petitioner indicated that «Ingushvodkhoz» had been preventing the bidders from submitting the bids for the auction.

Investigating the case, the FAS Russia's Commission established that the Petitioner failed to corroborate the arguments, stated in the complaint, at the Commission's session, and recognized the complaint ungrounded.

Under Part 5 Article 17 of the Law, FAS Russia carried out an unscheduled inspection and discovered that when the Ordering Party, selecting auction as the form of competitive bidding, allowed certain procedures that contravened the Law.

Furthermore, the Ordering Party failed to carry out the bid-pre-qualification procedure and singed the government contracts before the statutory period was over.

Having processed the case, FAS Russia has forwarded the materials to a responsible official of the Chechen-Ingushsky Regional Office of FAS Russia to initiate an administrative investigation under Parts 2 and 4 Article 7.30 and Part 1.2 Article 7.32 of the Code of the Russian Federation on Antimonopoly Violations.
