Press-release of 23.07.2008 «Results of enforcement of the Federal Law «On State Procurement…»

The Federal Antimonopoly Service summarized the results of enforcement of the state procurement legislation in the second quarter of 2008.

In the second quarter 2008 FAS Russia organized:

- 176 scheduled inspections;

- 1586 unscheduled inspections of federal procurement;

- 1245 unscheduled inspections of procurement for the needs of the constituent territories of the Russian Federation;

- 1469 unscheduled inspections of municipal procurement.

Based on the outcome of scheduled inspections, FAS Russia directed 124 determinations to eliminate the violations of the state procurement legislation, issued 1684 determinations on eliminating the violations to the federal, regional (the constituent territories of the Russian Federation) and municipal ordering parties.

In the second quarter FAS Russia initiated 1264 cases on administrative violations: 551 were related to federal procurement, 182 - to procurement for the needs of the constituent territories of the Russian Federation, and 531 - to municipal procurement. As a result, FAS Russia adopted 542 resolutions on imposing administrative fines for the total amount 15 194 000 Rubles.

Majority of the resolutions on imposing fines (352) were issued under Part 2 Article 7.30 of the Code of Administrative Violations: the ordering parties mostly violated procurement procedures, namely - statutory requirements to the publication dates in an official print media.

Summing up state procurement enforcement in the second quarter 2008, FAS Russia revealed 5448 violations of the procurement legislation, including:

- 312 cases when the ordering parties selected a wrong procurement method;

- 1789 cases when the ordering parties set requirements to the bidders which contravened the Law «On State Procurement…»;

- 565 cases when bidders were unjustly allowed to participate in the bidding or quotation request;

- 634 cases when bidders were unjustly prevented from participating in the bidding or quotation request;

- 536 cases when the tender notification and tender documentation contained bids evaluation criteria that are not specified by the Law «On State Procurement…»;

- 729 cases when the tender notification and tender documentation did not contain procedures for bids evaluation;

- 421 cases when the protocols, required in accordance with the Law «On State Procurement…», were not placed (published) on schedule.
