On 23rd July 2008, the Khabarovsk Office of FAS Russia (OFAS Russia) recognized collusion between «Khabarovsknefteproduct» OJSC and «RN-Vostoknefteproduct» OJSC and issued a determination to eliminate the antimonopoly violation.
Khabarovsk OFAS Russia established that despite different pricing approaches and conditions of economic operations, «Khabarovsknefteproduct» OJSC and «RN-Vostoknefteproduct» OJSC more or less simultaneously increased the selling prices for oil products at their refueling stations. Inspections and analysis of the data presented by the companies showed the absence of objective grounds for such increases. The antimonopoly office found that the actions of «Khabarovsknefteproduct» OJSC and «RN-Vostoknefteproduct» OJSC violated Part 1 Article 11 of the Federal Law «On Protection of Competition», which prohibits concerted actions of economic agents on the goods markets.
Khabarovsk OFAS Russia issued a determination to «Khabarovsknefteproduct» OJSC and «RN-Vostoknefteproduct» OJSC requesting them to eliminate the antimonopoly violation. The Office is considering possibility of imposing administrative charges on the companies under Article 14.32 of the Code of the Russian Federation on Administrative Violations.
