On 20th July 2009, the Federal Antimonopoly Service (FAS Russia) initiated a case against the Russian Ministry of Agriculture.

The FAS Russia's Commission will investigate legitimacy of the requirements set by the Russian Ministry of Agriculture about increasing the level of professional training of the workers involved in organisation of the works for decontaminating quarantine facilitates by gas and the works for gas removal, only in the federal state institutions subordinate to the Russian Ministry of Agriculture or Rosselkhoznadzor (the Federal Service for Veterinary and Phyto-Sanitary Control).

FAS Russia is also investigating the legitimacy of the requirement of the Russian Ministry of Agriculture to carry out the works for decontaminating quarantine facilitates by gas and the works for gas removal on the basis of a license for operating chemically hazardous industrial facilities in the absence of relevant statutory regulations.

Those requirements were set by Clauses 15 and 17 of No.414 Order of the Russian Ministry of Agriculture of 29th August 2008 «On Organising the Works for Decontaminating Quarantine Facilities by Gas and the Works for Gas Removal».

The case will be heard on 5th August 2009.
