On 4th February 2010, the Moscow Arbitration Court supported the decision and determination issued by the Federal Antimonopoly Service (FAS Russia) that «Bassol» OJSC and «Promsol» Ltd. violated the antimonopoly law. The prices for the products of «Bassol» OJSC increased by 55% following a contract signed between these companies.
FAS Russia found that «Bassol» OJSC and «Promsol» Ltd. violated Article ñ11 of the Federal Law «On Protection of Competition» (concerted actions).
In 2008 «Bassol» OJSC signed a contract with «Promsol» Ltd. for transferring exclusive rights for distribution of all products (salt), produced by «Bassol» OJSC, in the Russian Federation and other countries throughout the world for the whole contract period and increasing the prices for the products of «Bassol» OJSC.
«Bassol» OJSC disagreed with the decision and filed a lawsuit. Having examined the case evidence, the Arbitration Court confirmed validity of the FAS Russia's decision on inadmissibility of the agreement that had led to fixing or maintaining prices (rates), discounts, or mark-ups (surcharges).
